PicksHub Terms of Service

PicksHub is a coordination platform for private sports pools operated by Leucocholy Media, LLC ("PicksHub", "we", "our"). By creating an account, joining a pool, or otherwise using our web application, emails, or APIs (collectively, the "Service"), you agree to these Terms.

We may update these Terms from time to time. We will log revisions in our legal changelog and notify users of material updates when feasible.

1. Eligibility and Accounts

  • You must be at least 18 years old or the age of majority in your jurisdiction.
  • You are responsible for safeguarding your credentials and account activity.
  • Provide accurate, current, and complete information when registering or updating your account.

2. Organizer Responsibilities

  • Organizers control pool settings, roster approvals, reminders, and communications sent to their members.
  • PicksHub never collects, holds, escrows, or distributes participant entry fees or winnings. Organizers are solely responsible for any offline payments or prizes associated with their pools.
  • Organizers must observe all laws that apply to contests, sweepstakes, or gaming in their locale.
  • Do not imply that PicksHub processes payments or guarantees prize delivery.

3. Participant Responsibilities

  • Review pool rules, deadlines, and organizer messages before submitting picks.
  • PicksHub does not warrant the accuracy of organizer overrides or prize statements.
  • Do not automate pick submissions, harvest addresses, or spam invitations.

4. Acceptable Use

  • Use the Service only for lawful purposes and in line with our content standards.
  • Do not upload abusive, defamatory, hateful, or infringing material.
  • Do not disrupt the Service, bypass security, or reverse engineer our software.

5. Fees and Billing

  • Organizers may purchase additional capacity or features; pricing appears at checkout.
  • Payments to PicksHub are processed by providers such as Stripe. We do not process organizer-to-participant funds.
  • Refunds are governed by the terms displayed at the time of purchase.

6. Data and Privacy

Our Privacy Policy explains what information we collect and how we use it. We implement role-based access controls, audit logging, and deletion schedules documented in our data retention policy.

7. Third-Party Services

The Service integrates with Supabase, Vercel, Resend, Stripe, Sentry, and other providers. Their terms of service apply where you use their features. PicksHub is not responsible for third-party outages or changes.

8. Intellectual Property

  • The Service, logos, and software are owned or licensed by PicksHub and protected by law.
  • You retain rights to content you submit but grant us a license to host and transmit it to deliver the Service.
  • You confirm you have rights to the content you contribute.

9. Disclaimers and Limitation of Liability

The Service is provided on an "as is" basis without warranties of any kind. To the fullest extent allowed by law, PicksHub and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenues, or data. Total liability is limited to the greater of $100 USD or the fees you paid to PicksHub in the preceding 12 months.

10. Indemnification

You agree to indemnify and hold PicksHub harmless from claims and expenses arising from your use of the Service, your content, or violation of these Terms or applicable law.

11. Suspension, Termination, and Governing Law

We may suspend or terminate access if you violate these Terms or applicable law. These Terms are governed by the laws of the State of Delaware, USA. Disputes will be resolved in the state or federal courts located in Wilmington, Delaware.
